France – white collar crime and corruption

One area that is important in the fight against corruption is positive engagement of the private sector in corruption prevention. The National Law Review, highlights France’s use of audits and internal compliance in businesses. “Over the last decade, France has transformed its approach to fighting corruption, shifting from a reactive stance to a comprehensive, prevention-oriented regime designed to embed anti-corruption compliance into the very fabric of corporate governance.”  This includes increasing the power of the French Anti-corruption Agency, providing it with additional discretionary powers, as well as working externally with other international jurisdictions.

Why should we care? This article highlights the need for greater involvement of French authorities in anti-corruption cases, both at home and abroad. The importance of this issue has been commented upon in several articles, in that there has been a decrease of interest in cross-border corruption enforcement by the United States. To overcome this deficit, it has become obvious that other jurisdictions will need to come forward. This article notes what France is doing and needs to do proactively. All of which provides all of us with some reassurance in the anti-corruption community.
