Corruption in the US – still fighting
The progressive publication The American Prospect, highlights the work of lawyers who will not go into the night quietly about corrupt actions in the US. As has been shown there have been concerning actions by the Trump Administration tied to mergers. A pay-to-play culture seems to be pervading the FCC, and the work that they perform affects people. In this instance “[t]op Democrats and outside anti-monopoly reformers are preparing to call on U.S. District Court Judge Casey Pitts to engage in a deep review of the merger settlement between Hewlett Packard Enterprise (HPE) and Juniper Networks. The mechanism is the Tunney Act, a 1974 law passed in response to Nixon-era corruption in antitrust cases.” This came about as there were a number of concerns involving the Department of Justice anti-trust department, possible improper deals, leading to the approval of a settlement. This is where the Tunney Act comes in, allowing the judge who has to approve the settlement can independently review the settlement, and determine if it is in the public interest.
Why is this important? Even though this may not lead to the settlement being thrown out, it will shine a light on the meddling, behind the scenes, by the White House, lobbyists, and departments of the Justice Department are meddling in antitrust cases. This might also provide some support to lessen the political machinations that have been occurring around the anti-trust division. This is one more tool to shine a light on possible corrupt actions, reminding us that the public should know what is being done and should be protected.
